To ensure a safe, enjoyable, and respectful environment for all visitors, the Muscarelle Museum of Art has established the following policies for events held at our venue. By attending our events, you agree to abide by these guidelines.
1. Behavior and Conduct: All visitors are expected to behave in a respectful and courteous manner towards other guests, staff, and volunteers. Any form of harassment, discrimination, or disruptive behavior will not be tolerated. The consumption of alcohol is only permitted in designated areas and during events where alcohol is served. The use of illegal drugs is strictly prohibited on museum premises. Please be mindful of noise levels to ensure that all guests can enjoy the event. Loud or disruptive behavior may result in removal from the event.
2. Safety: In the event of an emergency, please follow the instructions of museum staff and emergency personnel. Familiarize yourself with the location of exits and emergency equipment. Do not block fire exits or obstruct pathways. Tampering with fire safety equipment, including alarms and extinguishers, is prohibited. Keep personal belongings with you at all times. The museum is not responsible for lost or stolen items.
3. Liability: By attending an event at the Muscarelle Museum of Art, you assume all risks associated with your participation. The museum is not liable for any injury, loss, or damage to persons or property. Any damages caused to museum property by a visitor will be the financial responsibility of the individual(s) involved. This includes repair or replacement costs. Visitors are expected to follow all health and safety guidelines in place at the time of the event. This may include wearing masks, maintaining physical distance, and adhering to any other measures deemed necessary by the museum.
4. Accessibility: The Muscarelle Museum of Art is committed to providing accessible experiences for all visitors. If you require special accommodations, please contact us in advance to make arrangements.
5. Photography and Recording: Photography for personal use is generally permitted unless otherwise indicated. Flash photography, tripods, and selfie sticks are not allowed. Photography and recording for commercial purposes are not allowed without prior written permission from the museum.
Artworks and images viewed on this site may be protected by copyright which is noted whenever possible. The Museum does not warrant that reproduction of the artwork will not infringe on the rights of third parties. It is the responsibility of the user to determine and satisfy copyright or other use restrictions prior to copying, transmitting, or making other use of protected works beyond that allowed by “fair use” as such term is understood under the United States Copyright Act.
If a work was created by an entity that is no longer living and has been deceased for more than 70 years, that work is believed to be in the public domain and free of other restrictions, according to US copyright law. These images are considered to be fair use and are made freely available and downloadable for personal use. Fair use includes educational use, scholarly opinion, criticism or commentary, and research.
However, not every work of art and its images in Muscarelle’s collection is in the public domain nor free of restrictions. The Muscarelle works to protect images of objects that are believed to be under copyright to ensure that others’ intellectual property rights are protected. This is why some of the images are unavailable or thumbnails.
In spite of one’s best efforts, it may be difficult or impossible to locate the owner of copyright in a work. This is frequently because the work’s creator is anonymous, the company that owned copyright is inactive, or because the copyright owner’s identity is known but the owner or the owner’s representative cannot be located. These items are commonly referred to as “Orphan works.” If you are the representative for any artist or know the representative of a work identified as an “Orphan work,” please contact the Associate Registrar, Laura Fogarty at lfogarty@wm.edu.
If you wish to use such images for profit, merchandise, or other uses not deemed to be fair use, you must seek permission from the copyright holder in addition to requesting an image from the Muscarelle’s rights and reproductions manager, Laura Fogarty at lfogarty@wm.edu.
